Relief for Delhi’s Old Vehicle Owners: Supreme Court Pauses Ban for Now

Recently, the Supreme Court has given some good news to individuals who are owners of old cars and bikes in the Delhi NCR region. For now, there will not be any strict action for vehicles that fall under the definition of “end of life” under the existing regulations.

Previously, orders by the court included that diesel vehicles older than 10 years and petrol vehicles older than 15 years could not operate in Delhi. The ban was meant to reduce air pollution; however, many people argued this was unfair, especially if their vehicles were in good condition and were passing the Pollution Under Control (PUC) tests.

The Delhi government also agreed with this perspective. They noted that rather than banning older vehicles based on age alone, it would be better for regulations to consider how much pollution a vehicle actually causes. For example, a well-maintained diesel car with a valid PUC could pollute less than a poorly maintained 5-year-old vehicle.

Due to some of these arguments, the Supreme Court has currently suspended its coercive measures: challans, seizing vehicles, and banning them from refuelling their old vehicles. This relief will stay in place until the next court hearing, expected in a couple of weeks.

This decision is significant because there are thousands of Delhi residents who rely on older vehicles, as part of their daily travelling or business needs. Prior to this decision, the traffic police and enforcement teams were issuing challans, or stopping such vehicles, or, unfortunately, in some instances, people were banned from filling up on fuel from petrol pumps.

Public Response to the Court’s Decision

Many vehicle owners have viewed the Supreme Court’s action as welcome news. For them, their car or bike is more than a means of getting around; it is a financial investment, also. Delhi’s Environment Minister called the decision a “big relief,” especially after the confusion caused by the earlier plan to stop fuel sales to old vehicles.

That plan was set to be operated on November 1, but due to the court’s temporary stay on the original decision, it is now in the form of a lawful pause. This delay gives the government the opportunity to design a more thoughtful, practical policy to guarantee clean air without unnecessarily setting people back suddenly.
